1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of WapiConnect ("Service", "Platform", "we", "us"), operated by flycheaplynow.com. By creating an account, clicking "I Agree", or using any part of the Service, you confirm that:

• You have read, understood, and agree to be bound by these Terms
• You are at least 18 years of age
• You have the legal authority to enter into this agreement on behalf of yourself or your organization
• Your use complies with all applicable local, state, national, and international laws

2. Description of Services

WapiConnect is a Software-as-a-Service (SaaS) platform that enables businesses to:

• Connect and manage WhatsApp Business numbers via the Meta Cloud API
• Send and receive WhatsApp messages with customers
• Create, manage, and send approved message templates
• Run broadcast campaigns to opted-in contact lists
• Manage customer contacts and conversation history
• Access message analytics and delivery reports

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts & Registration

To use WapiConnect, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account
• Not share account access with unauthorized parties

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Acceptable Use Policy

You agree to use WapiConnect only for lawful business communication. You must not use the platform to:

• Send unsolicited messages (spam) to people who have not opted in
• Send messages promoting illegal products, services, or activities
• Distribute malware, phishing links, or fraudulent content
• Harass, threaten, or intimidate any person
• Impersonate another business or person
• Violate any person's privacy or data protection rights
• Send content that is sexually explicit, hateful, or discriminatory
• Circumvent or attempt to bypass Meta's WhatsApp Business policies
• Use automated systems to create fake accounts or scrape data
• Re-sell or resell access to the platform without authorization

Violation of this policy may result in immediate account termination and may be reported to relevant authorities.

5. WhatsApp & Meta Compliance

As a user of the Meta WhatsApp Business Cloud API through our platform, you are also subject to Meta's policies:

• WhatsApp Business Policy: You must comply with WhatsApp's Business Policy at all times
• Template Approval: Message templates require Meta approval before use — we submit them on your behalf
• Opt-in Requirement: You must have explicit opt-in consent from contacts before messaging them
• Commerce Policy: Certain product categories are restricted or prohibited on WhatsApp
• Quality Rating: Poor messaging quality may result in your number being restricted by Meta

WapiConnect is not responsible for Meta suspending or restricting your WhatsApp number due to policy violations on your part.

6. Payment & Subscriptions

WapiConnect offers both a free trial and paid subscription plans.

• Free Trial: Limited to 20 messages/month with no payment required
• Paid Plans: Billed monthly or annually as per the selected plan
• Auto-renewal: Subscriptions renew automatically unless cancelled before the renewal date
• Refunds: We offer pro-rated refunds within 7 days of the billing date if you are unsatisfied
• Price changes: We will notify you 30 days in advance of any price changes
• Non-payment: Accounts with overdue payments may be downgraded to the free tier

7. Data Ownership

You retain full ownership of:

• Your customer contact data
• Message content you send and receive
• Templates and campaigns you create
• Any business data you upload to the platform

By using WapiConnect, you grant us a limited license to process this data solely to provide the Service. We do not claim ownership of your data and will not use it for any other purpose.

8. Intellectual Property

The WapiConnect platform, including its design, code, branding, and documentation, is the intellectual property of flycheaplynow.com. You may not:

• Copy, modify, or distribute our software or design without written permission
• Reverse engineer or decompile any part of the platform
• Use our brand name, logo, or trademarks without authorization
• Create derivative works based on our platform

9. Disclaimers & Limitations of Liability

The Service is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law:

• We do not guarantee uninterrupted or error-free service
• We are not liable for actions taken by Meta/WhatsApp including number restrictions
• We are not responsible for message delivery failures beyond our control
• Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages

10. Termination

Either party may terminate the agreement:

• By you: Cancel your subscription and delete your account at any time via account settings
• By us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for non-payment

Upon termination, your access to the Service ends immediately. Data may be retained for up to 30 days for recovery purposes before permanent deletion.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of India. If any provision of these Terms is found invalid, the remaining provisions continue in full force.
